Zambian President suspended judges over judicial misconduct
Zambian President Hakainde Hichilema has suspended three top Constitutional Court judges following allegations of judicial misconduct, acting on the recommendations of the Judicial Complaints Commission (JCC). The suspension of Justice Annie Sitali, Justice Mungeni Mulenga, and Justice Palan Mulonda reflects the president’s commitment to upholding accountability within the judiciary and ensuring that misconduct allegations are thoroughly investigated.
The decision comes after a two-year investigation into the judges’ handling of a 2016 presidential election petition. In that case, the trio ruled against Hichilema, who at the time contested the election results in favor of his predecessor, former President Edgar Lungu. The judges also played a role in a later decision allowing Lungu to run for a third term in 2021, despite constitutional term limits.
The suspension, announced earlier this week, emphasizes the importance of transparency and judicial integrity, particularly as the country approaches its 2026 elections. In line with constitutional procedures, the judges will face a disciplinary process to determine whether they will be reinstated or removed from the bench.

Political analyst Laura Miti noted the significance of holding the judiciary to high standards, stating that “the integrity of the courts is crucial for Zambia’s democracy.” At the same time, political tensions remain high, particularly with former President Lungu signaling a return to the political arena for the upcoming 2026 elections.
President Hichilema’s administration has yet to address claims of political interference, but supporters argue that the president is acting within his constitutional authority to ensure justice and fairness in Zambia’s democratic processes.
The suspended judges’ case will be closely watched, as it could have significant implications for the upcoming election and the broader state of Zambia’s judiciary.
